侵权责任法在产品责任中规定了惩罚性赔偿制度，该制度的设立具有公正、正义和秩序等法理基础和正当性。现阶段除了产品侵权需要严加惩罚外，笔者认为其他恶性的、严重危及社会公众利益的，造成财产损害或人身损害的行为也可以主张惩罚性赔偿。同时立法应从保护被侵权人利益和维护社会正义出发，应适当扩大惩罚性赔偿请求权主体范围。
侵權責任法在產品責任中規定瞭懲罰性賠償製度，該製度的設立具有公正、正義和秩序等法理基礎和正噹性。現階段除瞭產品侵權需要嚴加懲罰外，筆者認為其他噁性的、嚴重危及社會公衆利益的，造成財產損害或人身損害的行為也可以主張懲罰性賠償。同時立法應從保護被侵權人利益和維護社會正義齣髮，應適噹擴大懲罰性賠償請求權主體範圍。
침권책임법재산품책임중규정료징벌성배상제도，해제도적설립구유공정、정의화질서등법리기출화정당성。현계단제료산품침권수요엄가징벌외，필자인위기타악성적、엄중위급사회공음이익적，조성재산손해혹인신손해적행위야가이주장징벌성배상。동시입법응종보호피침권인이익화유호사회정의출발，응괄당확대징벌성배상청구권주체범위。
The tort liability law has stipulated the system of punitive damages in products liability .The establishment of the system has its justice ,justice and order and the legal basis and legitimacy .At this stage ,in addition to product tort ,it needs to punish severely ,the author thinks that other malignant ,seriously endangering the social public interests , causing property damage or personal injury actions can also claim punitive damages .At the same time ,legislation should protect the victim interests and the maintenance of social justice , should expand the scope of punitive compensation right to claim properly .
