《工伤保险条例》规定，职工因工受伤需要停工接受医疗的，停工留薪期内原工资福利待遇不变。停工留薪期满后仍需治疗的，须经劳动能力鉴定委员会确认。实践证明，“确认”才能有序，才能确保工伤保险基金的使用效率和工伤职工的合法权益。但目前缺乏可操作性的确认标准、较完善的运行机制和明晰的确认流程。亟待加强确认标准的制定，改进确认方法，促进确认工作的常规化和规范化。

《공상보험조례》규정，직공인공수상수요정공접수의료적，정공류신기내원공자복리대우불변。정공류신기만후잉수치료적，수경노동능력감정위원회학인。실천증명，“학인”재능유서，재능학보공상보험기금적사용효솔화공상직공적합법권익。단목전결핍가조작성적학인표준、교완선적운행궤제화명석적학인류정。극대가강학인표준적제정，개진학인방법，촉진학인공작적상규화화규범화。
Based on the Regulations of Industrial Injury Insurance, the wages and welfare of workers injured at work should be unchanged during the period of rest for treatment. After this period, the validation of the demands for treatment from them should be conducted by the Labour Ability Assessment Committee. It has been proved that “validation" can keep the procedure in order, ensure the industrial injury insurance fund to be used effectively, guarantee the legitimate rights and interests of injured workers. But a operational standard for validating the demands of treatment, a well working mechanism and a clear procedure to be established. The formulation of standard, the improvement of the method, the normalization and standardization of validation should be strengthened.
