人类进入二十世纪之后，逐渐意识到人权保护的重要性，而在人权保护之中，对于文化权利即精神层面权利的关注，上升到了历史从未达到的高度。中国在结束长达百年的战乱之后，也迅速的将视野回归到人权保护和文化权利保护的主流。本文从国际人权法与文化权利，以及文化权利保护与刑法之间的关系，探讨通过刑罚机制保护文化权利的必要性，以弥补当前保护机制，在面对文化权利受侵蚀的社会风险时的漏洞。
