人体基因资源在生物医药研究中起着至关重要的作用。随着生物技术的兴起，有关人体基因的专利带来了极大的收益。但是在人体基因专利的利益分享上却存在极大的矛盾，基因专利权人通过专利获得极大的经济收益，而人体基因资源的提供者却被排除在这一利益之外。在具体的基因利益分享中，应当在国家从整体上对基因资源享有主权的基础上，明确基因资源提供者的事先知情同意权、所有权和免费或低价使用权等权利。
人體基因資源在生物醫藥研究中起著至關重要的作用。隨著生物技術的興起，有關人體基因的專利帶來瞭極大的收益。但是在人體基因專利的利益分享上卻存在極大的矛盾，基因專利權人通過專利穫得極大的經濟收益，而人體基因資源的提供者卻被排除在這一利益之外。在具體的基因利益分享中，應噹在國傢從整體上對基因資源享有主權的基礎上，明確基因資源提供者的事先知情同意權、所有權和免費或低價使用權等權利。
인체기인자원재생물의약연구중기착지관중요적작용。수착생물기술적흥기，유관인체기인적전리대래료겁대적수익。단시재인체기인전리적이익분향상각존재겁대적모순，기인전리권인통과전리획득겁대적경제수익，이인체기인자원적제공자각피배제재저일이익지외。재구체적기인이익분향중，응당재국가종정체상대기인자원향유주권적기출상，명학기인자원제공자적사선지정동의권、소유권화면비혹저개사용권등권리。
Human gene resources play an important role in biomedicine researches. With the development of biotechnology, the human gene patents have gained great interests. But there are great conflicts in interest sharing. The patentees get great interests from gene patents, while the gene providers are excluded from such interests. In terms of gene interests sharing, we must establish gene providers’ right of prior information and consent, their ownership and their right to use gene resources for free or at a low-cost, on the basis of state authoritative ownership of the gene resources.
