权利贫困是法学解释中弱势群体的首要特征，而宪政是以宪法为前提、以法治为基石、以人权保障为目的的政治形态或政治过程。因此，作为“人权短板”的弱势群体其权利问题的研究解决属于宪政建设的重要内容。平等权是其他宪法基本权利实现的基础，宪法是弱势群体权利保障的最坚固壁垒，从宪法实施角度寻求基本权利救济，也是弱势群体平等权保护的重要途径。
