通过文献资料、时间观察、综合分析等研究方法对我国基本体育用地的合法性缺失与法律救济进行了探讨。研究认为基本体育用地是事关民生的内容、具有公共产品的属性，具有总体的公益性，因此具有通过法律保障的合法性。目前的体育用地相关法规文件不少，但存在指导性强、强制力差；制定的多、执行的差；原则性强、操作性差等问题，尤其是体育部门的行政文件规章，大都流于形式，源于基本体育用地现实合法性的缺失提出了法律补救的策略：立法价值取向---保证公民基本体育权利；立法应坚持非均衡的“均等化”供给思维；强化立法的强制力；提升立法的操作性、畅通群众诉求通道；关注弱势与特殊群体。

Through literature,observing,comprehensive analysis and other methods on the legitimacy of China's basic lack of physical space and legal remedies are discussed.Studies suggest that physical space is a matter of basic livelihood of the content,with the properties of public goods,with the general public,and therefore has legitimacy through legal protection.The current regulatory documents related to a lot of sports sites,but there are strong guidance,co-ercive power difference;developed many poor execution;principled,and poor maneuverability,especially in the sports department of administrative documents and regulations,mostly formality,from the basic reality of sports sites lack legitimacy legal remedies proposed strategy:Legislative value orientation.to ensure basic civil rights of sports;legislation should adhere to non-equilibrium of the “equalization”supply thinking;strengthen legislative coercion;improve legisla-tion maneuverability,smooth mass appeal channels;with special attention to vulnerable groups.
