2005年，最高人民法院发布了《二五改革纲要》，明确提出建立和完善案例指导制度。鉴于案例指导制度具有弥补立法的不足，制约自由裁量权，促进司法和执法统一的作用，各级政府部门纷纷效仿，在本辖区内积极探索建立案例指导制度，指导本部门的行政执法工作。然而，各地建立的案例指导制度存在不统一、不规范的现象，因此探讨行政指导性案例概念、名称、效力、发布主体等问题，具有重要意义。
2005年，最高人民法院髮佈瞭《二五改革綱要》，明確提齣建立和完善案例指導製度。鑒于案例指導製度具有瀰補立法的不足，製約自由裁量權，促進司法和執法統一的作用，各級政府部門紛紛效倣，在本轄區內積極探索建立案例指導製度，指導本部門的行政執法工作。然而，各地建立的案例指導製度存在不統一、不規範的現象，因此探討行政指導性案例概唸、名稱、效力、髮佈主體等問題，具有重要意義。
2005년，최고인민법원발포료《이오개혁강요》，명학제출건립화완선안례지도제도。감우안례지도제도구유미보입법적불족，제약자유재량권，촉진사법화집법통일적작용，각급정부부문분분효방，재본할구내적겁탐색건입안례지도제도，지도본부문적행정집법공작。연이，각지건립적안례지도제도존재불통일、불규범적현상，인차탐토행정지도성안례개념、명칭、효력、발포주체등문제，구유중요의의。
In 2005, the Supreme People's Court is sued the 25 reform outline, clearly proposed the estab lishment and perfection of cases guiding system. In view of cases guiding system will make up for the inadequacy of the legislation, restricting the discretion to pro-mote unity of the judicial and law enforcement. Since then, government departments at all levels have also followed suit, actively explore the case studies guidance in this area, and guide the work of the Department of administrative law enforcement. So all over the building of cases guiding system inconsistent, irregular, case concept, name, force guiding the discussion on administrative, publishing and other is-sues, is of great significance.
