中国企业与国际市场接轨中遭遇了知识产权危机。为了更好地配合中国企业"走出去"的发展战略，形成中国企业涉外知识产权的保护体系，本文结合本土国情，参考Trips协定对涉外知识产权内涵的界定，探索了形成合理的中国企业涉外知识产权的法律保护路径。

Chinese enterprises have suffered a crisis of intellectual property rights during the integration with the global market. In order to better cooperate with the Chinese enterprises"going-out"strategy and to form an en-terprise foreign-related intellectual property rights protection system, this paper, combining with local conditions and referring to the Trips agreement on foreign-related intellectual property rights, discusses on a reasonable legal protection path.
