集合犯与连续犯在客观方面表现出很大的相似性，但是，二者的区别也很明显。连续犯是司法现象，其数次行为出于行为人的一次犯罪决意，既表明数个犯罪行为之间具有不可分割的联系，也说明行为人罪责减少。刑法分则中的犯罪基本上都可以连续犯的方式实施。集合犯是立法现象，立法者基于实践经验，将多次行为规定为一罪，是因为这类行为表征了行为人具有较大的人身危险性，从社会防卫角度出发，必须加重行为人的刑事责任，从立法上对行为人进行否定评价。

That obscures the essential difference between them . The legal basis of the continuing offence lies in the reduced guilt . So judge does not combine punishments of the multiple crimes , w hich reduces the criminal responsibility . The legal basis of the aggregate offence lies in the personal danger of the dangerousness for defensing the community , so as to increase the penalty for criminals .
