在分析现有养老服务政策文件的基础上，提出养老服务地方立法应遵循的原则：社会普遍性、政府职能和社会责任兼顾、养老服务保障水平与地方社会经济发展相适应、以搭建养老服务体系为主循序渐进、地方养老服务立法体现相对独立性和创新性。老年人的权益保护为立法核心。应明确养老服务业的法律地位，根据地方社会需求确定养老服务体系和服务模式，推进养老服务的规范化和专业化，提升养老服务质量。要以养老服务社会保障为立法基础，要建立养老服务纠纷处理机制。

Firstly, this paper makes an analysis of the available policies and documents about old-age care service;then it proposes the principles that must be complied with by the local legislation of old-age service system, which include 1.social universality;2.taking into account both government function and social responsibility;3.the old-age service security level should be in compatible with the local economic development;4.to make step by step progress while centered on the establishment of old-age service system;5.the local legislation of old-age service system should reflect independence and innovation. Finally, it’s suggested in this paper that 1.the legislation core should be deifned as the protection of the rights and interests of the elderly;2.the legal status of old-age care service industry should be stated clearly; 3.the old-age service system and the service model should be based on the local demands;4.pushing on the standardization and professionalization of the old-age care service to promote the service quality;5.establishing the dispute settlement mechanism of old-age care service on the legislative basis of social security of old-age care service.
