在当前藏区司法领域，赔命价与国家刑事法制形成冲突，成为藏区社会稳定的隐患。破解此难题，可以从历史中借鉴成功经验。清代中央政府依循“轻其所轻、重其所重”的思路，将赔命价纳入国家法制，利用土司制度解决藏区私人相犯的刑事案件，使赔命价成为藏区社会稳定的有益因素。历史的启示是：解决赔命价难题，藏区政法机关需要摒弃单一的“取缔”思维，寻找赔命价与国家刑事法制之间的契合点和可沟通之处，从而在程序法上实现对赔命价的吸收、在实体法上实现对赔命价的现代化改造，使赔命价为社会主义法治释放正能量。

In Tibetan Judicial field today, the conflict between the compensation for life and State Criminal Law results in the Instability on Tibetan area.Successful cases from the past could be referred for the resolution of the current difficul-ties.Central government in Qing Dynasty abided by the approach of punishment in accordance with the concrete situation and brought it into the national judicial law.The Government took Tusi System of dealing with the issues as reference and resolute the compensation for life, which were the meaningful factors for social stability.Enlighten from history, the resolu-tion should not deal with by cancelling, but find the key points to absorb by process and reform by concrete, so as to release the positive power for socialist rule by law.
