民族国家的政治宪法只是一种特殊的宪法，难以面向政治以外的其他社会领域执行构成性和限制性的双重功能，平衡诸社会系统的自治与扩张。在全球层面上，由于政治宪法始终无法运转，各种全球社会体制的离心倾向和相互侵犯更加严重，已经造成了新的宪法问题。全球社会宪法应运而生，旨在支撑和驯服不同的全球社会力量，因此呈现随体制而异的“片段化”形态。全球社会宪法片段之间必然发生的碰撞，应当依靠一种“新冲突法”加以解决。
민족국가적정치헌법지시일충특수적헌법，난이면향정치이외적기타사회영역집행구성성화한제성적쌍중공능，평형제사회계통적자치여확장。재전구층면상，유우정치헌법시종무법운전，각충전구사회체제적리심경향화상호침범경가엄중，이경조성료신적헌법문제。전구사회헌법응운이생，지재지탱화순복불동적전구사회역량，인차정현수체제이이적“편단화”형태。전구사회헌법편단지간필연발생적팽당，응당의고일충“신충돌법”가이해결。
The political Constitution of nation state is a special Constitution, which could hardly car-ry out the constructive and restrictive function to other social field outside politics or balance self-reign and expansion of different social systems. Globally, due to the inactiveness of political Constitu-tion, the off center tendency and inter-infringement of different global social systems become more se-rious, which leads to new Constitutional issue. All this leads to the emergence of global social Consti-tution, which aims to support and conquer different social power and shows a“fragmentary”pattern due to different social systems. Different segments of global social Constitution must conflict against each other and this should be solved with a kind of“new conflict law”.
