2011年颁布的《旅行社责任保险管理办法》对旅游领域的旅行社责任保险做出新的强制性性规定，新规的出台对于保护旅游事故受害人利益、预防和减少旅游事故发生将发挥重要作用。但作为承载着法律正义价值的旅行社责任保险制度，其在立法及实务中仍存在着保险人承担保险给付性质界定不明、承保责任范围不严谨、除外责任条款欠缺、受害人利益保护不充分等问题。本文试图从扩展旅行社责任保险承保范围，规范旅行社责任保险除外责任条款，强化受害第三人保护机制方面探索解决对策，以期对我国旅行社责任保险法律制度的进一部完善有所裨益。
2011年頒佈的《旅行社責任保險管理辦法》對旅遊領域的旅行社責任保險做齣新的彊製性性規定，新規的齣檯對于保護旅遊事故受害人利益、預防和減少旅遊事故髮生將髮揮重要作用。但作為承載著法律正義價值的旅行社責任保險製度，其在立法及實務中仍存在著保險人承擔保險給付性質界定不明、承保責任範圍不嚴謹、除外責任條款欠缺、受害人利益保護不充分等問題。本文試圖從擴展旅行社責任保險承保範圍，規範旅行社責任保險除外責任條款，彊化受害第三人保護機製方麵探索解決對策，以期對我國旅行社責任保險法律製度的進一部完善有所裨益。

The Regulation about Travel Agency Liability Insurance promulgated in 201 1 has made the new compul-sory regulations on the field of travel liability insurance.The new regulations will play an important role in protec-ting the tourism accident victim’s interest,preventing and reducing accidents.Although the travel agency liability insurance system bears legal justice value,its legislation and practice still have some problems such as the unknown of the nature of insurance payment about the insured,the coverage being unclearly defined,the deficiency of clau-ses of excluded liability,and the interests of victims being inadequate.In order to improve the legal system of travel agency liability insurance,this paper attempts to explore solutions from these respects on extending the travel agen-cy liability insurance coverage,thus regulating the insurance exclusion clause,and strengthening the protection of the third victim.
