从客观衡量专利池促进效率和抑制效率的综合效果出发，构建了基于垄断行为确定、行为结果认定和因果关系判定的国外专利池反垄断的 B-E-C 决策标准以及标准值域确定方法，实证分析了2004年我国企业在美起诉 DVD 3C 专利池案件，提出了国外专利池反垄断的对策性建议。

Base on the objective measure of the comprehensive effect between the promotion efficiency and inhibition effi-ciency which belong to the patent pool,constructs B-E-C anti-monopoly decision-making standards which is composed of the behavior of monopoly,the effect of behavior and the causality between them,and the methods to determinate the value of each standard.Makes an empirical research on the file that our country's enterprises prosecute DVD 3C in the United States in 2004,draws the related conclusions and puts forward approaches to the anti-monopoly of the foreign patent pool.
