根据利益平衡原则，著作权法在保护作者著作权时应为图书馆等公共文化服务设施提供合理使用的空间，另一方面图书馆合理使用的目的、对象、方式、限制等方面也要严格的立法规范，以避免著作权与图书馆的合理使用发生冲突。比较而言，台湾地区具有相对完备的图书馆法律体系，为图书馆合理使用著作提供了制度基础，这对推动大陆地区图书馆法进程并从根本上规范图书馆合理使用权，扩大公共信息服务职能提供了有益启示。

According to the principle of balance of interests, library may enjoy the fair use right while the author′copyright is protected in the copyright law.To avoid the conflict between the fair use and the copyright, rigorous legislation should be required for the scope of public libraries, fair use purposes, objects, methods, and reasonable restrictions on fair use.In comparison, a relatively complete library law system include the library social function and public interests character was established in Taiwan region, which provided the li-brary the institution basis to fair use the works.These experiences of Taiwan region can provide a useful insight to promote the mainland library specification process and the right of fair use of libraries to expand the public information service.
