基于对芜湖市实地调研,总结出我国集体建设用地流转存在的问题有:①集体建设用地产权缺陷;②集体建设用地价格较低、融资困难;③再次流转规范管理有待加强;④征地与流转两种形式难以衔接和配套;⑤流转中介服务组织缺失。规范集体建设用地流转的建议:①积极探索农村土地制度改革创新,一要探索集体建设用地流转立法保障;二要明晰集体土地产权;三要改革现行的土地征收制度。②完善集体建设用地流转机制,建立城乡统一的建设用地市场。③通过健全农村社会保障体系和建立农村金融支撑体系,完善集体建设用地流转配套措施。

Based on the ifeld research of Wuhu, this paper gives a conclusion about the issues concerning the transfer of rural collective construction land, these are:the defects of property rights, low land prices and ifnancing dififculties;standardized management of a second time circulation have yet to be strengthened;It is dififcult to join land expropriation and land transfer;and lack of intermediary service organizations. To cure the above problems, this paper presents that we should explore the legislative guarantee of collective construction land circulation, define the property rights of collective land, and reform the current land expropriation system. At the same time, we should improve the mechanism of collective construction land circulation, and establish a unified urban and rural construction land market. In addition, supporting measures must be improved via perfecting rural social security system and establishing rural ifnancial support system.
