由于法律法规的缺失，政府作为BT项目发起人可能面临着法律风险，政府机构及相关责任人可能因此陷入违法境地并承担法律责任和行政责任，也由此阻碍了BT模式的良性发展。以BT项目的发起为起点，分析政府作为BT项目发起人可能面临的四种法律风险，并就如何防范存在的法律风险提出相关建议。

Because of the absence of law s and regulations ,the government may face legal risks as the project sponsor ,and the governmental organs and the relevant responsible persons may thus get into illegal situations and bear legal and administrative responsibilities ,w hich hinder the sound development of the BT Mode .Starting from the initiation of a BT project ,this article analyzes four legal risks the government may face as the project sponsor ,and proposes some related suggestions for the legal risk control .
