在奉行当事人主义与保障被告人人权的刑事诉讼体系下,被告人才是阅卷权的主体,而且被告人应当有权自行行使阅卷权。在具体案件中,仅靠辩护律师并不能起到最好的辩护效果,需要被告人予以配合,而被告人配合的前提是能够亲自阅卷。辩护制度要基于被告人与辩护人之间的信赖关系建立,而非国家与辩护人之间的信赖关系。基于特殊信赖,赋予辩护律师较之被告人与其他辩护人更大的阅卷权,并非源自辩护制度的理论基础。被告人在案卷移送审查起诉之后即应享有阅卷权,但这也只是一个保守的结论。

In the system that the lawsuit participators＇human right should be protected,the defendant is the subject of the material reading right,and they should enjoy such kind of right on their own.In the specific cases,it needs the cooperation of the defendant,while the necessity is that the respondents can read the material by themselves.The justification system should base on the construction of the trust relationship between the defendant and the counsel,not between the defendant and the country.On the basis of such special trust,giving more right for the counsel than that for the defendant or other participators is not from the theory base of the vindication system.The defendant enjoy the right after the case is initiated,however,it is a conservative conclusion.
