不能犯可罚性的判断标准,直接体现了刑法基本立场的选择,国内外刑法学界也存在着多种学说以探讨不能犯可罚性的问题和其判断标准。通过厘清刑法学的基本立场、基本理论在处理不能犯问题时的选择与作用,以及对多种学说的比较分析,认为印象说更具有合理性和可行性,并以现代社会普遍联系为考察视角,从预防功能角度出发,尝试探讨加入考虑行为导致不能犯的偶然性及其相关因素,帮助判断其可罚性,并以此修正印象说的固有缺陷。

The standards for the punishment of incapable crimes directly reflect the choice of the basic position on the criminal law.Many theories are used to explore the punishment of incapable crimes and its standards in the academic circle of the criminal law both at home and abroad.By comparing and analyzing the various theories and clarifying the choices and functions of the criminal law＇s basic principles and theories in handling the punishment of incapable crimes,this paper believes that the impression theory is more reasonable and feasible.It also considers some accidental and related factors that lead to incapable crimes in order to judge the possibility of their punishment and correct the inherent flaws of the impression theory from the perspective of general connection in modern society and that of preventive function of law.
