环境保护行政合同通常具有时间跨度大、涉及面广等特性,在此期间,如发生导致双方权利义务关系发生重大变化的事由,变更或者解除制度是平衡当事人之间权利义务的必要工具。在相关制度安排与设计中,既要注意并尊重环境保护行政合同与民事合同相关制度的共性,更要关注两者个性所带来的影响并做出相应的安排。
