以合法不合道德行为为研究对象，通过分析中西不同文化背景下法律与道德关系，总结出导致该行为的两个主要原因。一方面是因为现行法律与社会伦理道德脱节，使许多违背道德的丑恶行为不能受到现行法律的制裁；另一方面是由于法律与道德适用的范围不同，法律是划分罪与非罪，合法与违法的标准，道德则主要是划分善与恶的准绳，这两种界限在一定范围内重合但同时存在不重叠的部分。针对社会中屡屡出现的合法不合道德的现象，提出制定良法，引发公民自觉性；去除障碍，充分发挥道德作用；在坚持法律权威前提下，强化道德评价作用；依据道德构建指导法律实践的价值评判，使部分道德内化为法律的措施。

The research object of this paper is legitimate immoral behavior, analyzing Chinese and Western culture background of different relationship between law and morality, it found out two main reasons for the behavior. On one hand, due to the current legal and social ethical disconnection, many immoral behavior cant be sanctioned by current legal regulations; On the other hand, because legal and moral scope is different, the law is divided into crime and non - crime or legal and iUegal, morality is the mainly criterion of dividing good and evil, these two boundaries are in a certain range of coincidence but do not overlap, so the legitimate unethical behavior exists. In view of the society frequent legal unethical phenomenon, it can be reduced or even stopped from the following four aspects: to develop good law to arouse citizen consciousness; to remove obstacles for the function of moral; to strengthen the moral evalua tion function on the premise of insisting legal authority; to make some ethics converting into laws according to value judgment based on the moral construction.
