《关于办理刑事案件排除非法证据若干问题的规定》的颁布和实施意味着我国的非法证据排除规则已形成了体系。文章从实证的角度对我国非法证据排除规则现状作了研究;在充分肯定该规定积极意义的前提下,就司法实践中不足之处及需要完善的部分做了简要陈述,争取使我国的非法证据排除规则更好的为社会主义法律事业服务。
《關于辦理刑事案件排除非法證據若榦問題的規定》的頒佈和實施意味著我國的非法證據排除規則已形成瞭體繫。文章從實證的角度對我國非法證據排除規則現狀作瞭研究;在充分肯定該規定積極意義的前提下,就司法實踐中不足之處及需要完善的部分做瞭簡要陳述,爭取使我國的非法證據排除規則更好的為社會主義法律事業服務。

The promulgation and practice of ＂Rules on Handling the Problems of Exclusion of Illegal Evidence in Criminal Cases＂ on May 30th in 2010 marks that our country has developed a system in exclusionary rules of illegal evidence.This paper makes a research on the present exclusionary rules of illegal evidence in China from the perspective of the empirical study.With the positive attitude towards the rules,this paper makes a brief statement on the parts which are inadequate and need to be perfected in the judicial practice in order to make it carry more Chinese characteristics and offer better service to the socialist legal career.
