当事人询问以当事人本人作为证据方法,并以其陈述作为证据资料。大陆法系中,德国、日本和我国台湾地区都规定有当事人询问制度。我国《民事诉讼法》虽然把当事人陈述规定为独立的证据种类,但尚未区分证据意义上的当事人陈述与非证据意义上的当事人陈述。为了充分发挥当事人陈述对案件事实的证明作用,有必要引进大陆法系的当事人询问制度,并将之纳入证明妨碍制度体系。

Litigant Enquiry is enquiring the litigant himself as a method of evidence producing and takes the litigant＇s description as evidence materials.In civil law system,Germany,Japan and Taiwan in China have the litigant enquiry rules.Although our ＂Civil Procedure Law＂ has the Litigant Description as an independent category of evidence,it does not distinguish the Litigant Description in terms of evidence from Litigant Description in non-terms of evidence.For the purpose of getting the Litigant Description into full play in the act of proving the case,it is necessary to bring in the civil law system＇s Litigant Enquiry Rules.
