在案件事实认定中,传统形式逻辑的充分条件假言推理这一思维工具存在着固有的缺陷,我们应该对其前后件之间的关系进行清楚地刻画,否则就无法进行有效的推理。这种刻画在我们的案件事实认定中具有重要作用,有利于我们的法官正确顺利地完成案件事实认定工作,为正确判决的生成打下基础。
