为了完善农户退出宅基地进城落户政策，在现有相关研究的基础上，以陕西省出台的农户退出宅基地进城落户政策为研究对象，具体分析现有农户退出宅基地进城落户政策的制度缺陷及其原因。结果表明：陕西省农户退出宅基地进城落户政策主要存在宅基地退出的界定不明确、没有充分考虑进城落户农户退出宅基地的意愿、退出宅基地的补偿机制不完善、对退出宅基地农户的社会保障规定不健全、退出宅基地的利用及收益分配不明确、退出过程监管不足等问题。针对政策存在的问题，提出明确界定宅基地退出、尊重农户退出宅基地的意愿、完善宅基地退出补偿机制、完善退出宅基地进城落户农户的社会保障体系、建立合理的宅基地增值收益分配机制、明确相关部门职责等对策建议。

To perfect the policy of farmer homestead exit and moving in city to live,based on reviewing the existing related literatures,taking the policy of farmer homestead exit and moving in city to live (PFHEMCL)in Shaaxi province as research object,an appraisal on PFHEMCL in Shaaxi province was done.The results showed that some shortcomings on PFHEMCL in Shaaxi province existed,including the unclear definition of farmer homestead exit (FHE),not fully considering the farmers’willing of exiting their homesteads,the imperfection of the FHE mechanism and of social security system,the indeterminacy of exiting homestead use and benefit distribution and the imperfection of supervising the FHE,and some suggestions were put forward including defining clearly the FHE,respecting fully the farmers’exiting willings,improving the FHE mechanism and their social security system,establishing the reasonable benefit distribution mechanism to the added value of exiting farmers'homesteads and clearing the duty and responsibility of related government organs.
