对于很多案件，法官虽明显地感知到不应是夫妻共同债务，但苦于触昏姻法司法解释（二）》第二十四条所限，只好将其判为夫妻共同债务。个人债务判定为夫妻共同债务，造成了一定的社会危害。有人认为《婚姻法司法解释（二）》第二十四条存在缺陷，并希望通过立法来完善。但立法未必完美，而法律的运用则是一门艺术。我们怎样才可以把有瑕疵的法律加以无瑕疵地运用？本文试作一定的分析。

In many cases, judges have to sentence individual debt as joint debt of husband and wife according to article 24 in Marriage law Judicial Interpretation （ Ⅱ ）, which causes certain social harm. Some think that there are some defects in article 24 and hope to perfect it through legislation. But the author thinks that the way of legislation is not an ideal mean. Since the operation of law is an art, we can try to make the imperfect laws perfect in application.
