近年来，未成年人犯罪呈上升趋势，这一问题已经引起全社会的高度关注和重视。对未成年人犯罪的惩戒，核心价值不在于报应和震慑，解决问题的关键在于弱化、消除犯罪行为对社会造成的不良影响，侧重于对未成年人的身心矫治。检察机关运用刑事和解、暂缓起诉、社区矫正等“恢复性司法”制度处理未成年人犯罪，取得了良好的社会效果。运用“恢复性司法”处理未成年人犯罪，既有赖于立法的支撑，更有赖于司法的践行。
근년래，미성년인범죄정상승추세，저일문제이경인기전사회적고도관주화중시。대미성년인범죄적징계，핵심개치불재우보응화진섭，해결문제적관건재우약화、소제범죄행위대사회조성적불량영향，측중우대미성년인적신심교치。검찰궤관운용형사화해、잠완기소、사구교정등“회복성사법”제도처리미성년인범죄，취득료량호적사회효과。운용“회복성사법”처리미성년인범죄，기유뢰우입법적지탱，경유뢰우사법적천행。
In recent years, juvenile＇s crime has increasingly up warded, which has arouses the high concern and importance in the whole sociality. The punishment of juveniles crimes＇ core value is not the judgment and frighten but the core to the problem is to eliminate and reduce the bad influence of juveniles crime to the sociality, and attache more importance to the correction the juveniles＇ mind and body. Procuratorial office uses criminal reconciliation, community correction and such res to deal with the juvenile＇ s crime and gains some better social effects. Using to deal with juveniles crime is good to be the support of building up the law but is better to the practice of the law.
