我国现行地方行政立法监督机制存在审查监督的标准不明确、监督主体多元、职责不清、监督程序不完善等问题。应建立地方行政立法问责制,明确审查监督的标准,合理划分各监督主体的监督职责,并建立相互协调和衔接的监督机制,以进一步强化与完善对地方行政立法的法律监控。
我國現行地方行政立法鑑督機製存在審查鑑督的標準不明確、鑑督主體多元、職責不清、鑑督程序不完善等問題。應建立地方行政立法問責製,明確審查鑑督的標準,閤理劃分各鑑督主體的鑑督職責,併建立相互協調和銜接的鑑督機製,以進一步彊化與完善對地方行政立法的法律鑑控。
아국현행지방행정입법감독궤제존재심사감독적표준불명학、감독주체다원、직책불청、감독정서불완선등문제。응건입지방행정입법문책제,명학심사감독적표준,합리화분각감독주체적감독직책,병건립상호협조화함접적감독궤제,이진일보강화여완선대지방행정입법적법률감공。
Chinese current supervision mechanism of local administrative legislation has such disadvantages as unclear standards of review and supervision,variety and unclear responsibilities of supervision institutions,and imperfection of supervision procedure.The thesis proposes that accountability system of local administrative legislation should be established,standards of review and supervision should be made clear and duties of various supervision institutions should be divided reasonably.In addition,supervision mechanism with coordination and convergence should be established to further strengthen and improve legal supervision of local administrative legislation.
