有关刑罚的立法，是根据宪法的规定而制定的。刑法和刑事诉讼法，是最为重要的刑罚立法。刑法在广义上含刑法典、单行刑法、刑法修正案及具有准立法性质的司法解释。刑事诉讼法也含刑事诉讼法典及其司法解释。随着时代的发展和社会的变迁，这些刑罚立法，有些表现出与法治的基本准则不相一致的情况。要使刑罚立法真正体现法治国家的基本准则，需要构建刑罚立法复审制度。
유관형벌적입법，시근거헌법적규정이제정적。형법화형사소송법，시최위중요적형벌입법。형법재엄의상함형법전、단행형법、형법수정안급구유준입법성질적사법해석。형사소송법야함형사소송법전급기사법해석。수착시대적발전화사회적변천，저사형벌입법，유사표현출여법치적기본준칙불상일치적정황。요사형벌입법진정체현법치국가적기본준칙，수요구건형벌입법복심제도。
Penal legislation is made according to constitutional provisions. Criminal law and criminal procedure law are the most important penal legislation. In a broad sense, criminal law includes penal code, separate criminal law, criminal law amendment and judicial interpretations that bear the nature of quasi-legislation. Criminal procedure law includes criminal procedure code and related judicial interpretations. With the development of the time and the change of the society, these forms of legislation present inconsistence with basic requirements of rule of law. To reflect the basic requirements of a rule-of-law country, we need to establish a review system of penal legislation.
