认证机构承担的民事责任直接影响认证机构的发展,我国《电子签名法》只对认证机构的民事责任作了原则性的规定,是极其简单的,不能适应快速发展的电子商务活动。美国的＂建议的信赖限度＂规定认证机构承担民事限额责任,能对认证机构的发展起到促进作用。规定认证机构承担民事限额责任是存在合理性和科学性的,因此为了弥补我国立法的不足,并参考美国的法律,提出了完善我国《电子签名法》的立法意见,以促进我国认证机构朝着健康的方向发展。
認證機構承擔的民事責任直接影響認證機構的髮展,我國《電子籤名法》隻對認證機構的民事責任作瞭原則性的規定,是極其簡單的,不能適應快速髮展的電子商務活動。美國的＂建議的信賴限度＂規定認證機構承擔民事限額責任,能對認證機構的髮展起到促進作用。規定認證機構承擔民事限額責任是存在閤理性和科學性的,因此為瞭瀰補我國立法的不足,併參攷美國的法律,提齣瞭完善我國《電子籤名法》的立法意見,以促進我國認證機構朝著健康的方嚮髮展。

The civil liability which a certification authority（CA） shoulders affects the development of CA directly.Electronic Signature Law of The People＇s Republic of China only prescribes the principles of the civil liability of CA in an extremely simple way,which is not suitable for the rapid development of the e-commerce activities.＂Recommended Reliance Limit＂ of the United States prescribes that CA should shoulder the civil limited liability,which can promote the development of CA.The provision that CA should shoulder the civil limited liability is rational and scientific,so in order to make up for the shortage of Electronic Signature Law of The People＇s Republic of China,through referring the law of the United States,the article gives suggestions on the improvement of the law to ensure the healthy developing trend of CA of our country.
