合同相对性是传统合同法理论中的一项重要原则。随着经济的发展和贸易的繁荣，绝对的合同自由已经不能够涵盖合同法的全部，故出现了一些例外规定，其中建筑施工合同领域，允许实际施工人向发包人主张工程款就是合同相对性的突破，但这种突破作为一种例外应当要严格控制，否则会动摇整个合同。
