土地承包经营制度作为我国农村土地管理的根本制度为我国农村经济的发展发挥了至关重要的作用。然而，随着随着改革开放和农村经济的快速发展，在城乡二元化体制下建立的土地承包经营权流转制度凸显出不符合社会农村经济发展潮流，阻碍了土地承包经营权的法制化进程等问题，从现实情况出发，分析现阶段土地承包经营权流转过程中缺陷，并给出了相应的完善对策。

Land contract management system as the basic system for rural land management in China has played a vital role in the development of rural economy in China. However, with the reform and opening-up and the rapid development of rural economy, the recent land contracting management system hindered the legalization process contracted management of land. In this article, the author analyses the problems in recent circulation of rural land contracting management right and points out the countermeasures.
