无单放货是长期困扰海上货物运输实践的重要问题。无单放货保函没有改变无单放货的违法性,承运人应对正本提单持有人承担第一性责任;《鹿特丹规则》下凭指示放货的规定将一定条件下的无单放货行为合法化并为承运人创设了新的诉权,但承运人对无单放货承担第一性责任的法律地位没有变化。
無單放貨是長期睏擾海上貨物運輸實踐的重要問題。無單放貨保函沒有改變無單放貨的違法性,承運人應對正本提單持有人承擔第一性責任;《鹿特丹規則》下憑指示放貨的規定將一定條件下的無單放貨行為閤法化併為承運人創設瞭新的訴權,但承運人對無單放貨承擔第一性責任的法律地位沒有變化。

Delivery of goods without voucher is a great problem which troubles the practice of maritime transport for a long time. Letter of guarantee has not changed the illegality of delivery of goods without voucher. The carrier should assume the first responsibility to the keeper of the original bill of lading. Under "The Rotterdam Rules", the regulation of delivery of goods by order makes the behavior of delivery of goods without voucher legal and creates new right for the carrier to appeal. But it is unchanged that the carrier should assume the first responsibility for delivery of goods without voucher
