不动产登记是不动产物权变动的公示方法和生效要件，对于确认物权归属、解决物权冲突，保护交易安全、维护交易秩序，实现国家对不动产物权的宏观调控和监管等具有重要意义。因登记错误而产生的不动产登记机构赔偿责任因现行《物权法》的相关规定过于简单，在司法实践中容易发生适用困难，而且在处理登记错误的赔偿案件中经常发生重大分歧。所以必须通过对不动产登记错误的行为定性，来认定登记错误的赔偿责任、登记机构的归责原则以及如何进行具体的赔偿。

Real estate registration is the publication method and requirement of validity of real property transfer, which is of great significance to confirm the ownership, solve conflicts of property rights, protect transaction security, maintain trading order, and realize the state macro-control and regulation of property rights. As to the result of registration mistakes, the registration agency liability to pay compensation according to the current property law is too simple and difficult to apply in the judicial practice. Therefore, it is expected to define the behavior of registration mistake, determine the liability to pay compensation, and how to carry out the specific compensation.
