罪刑法定原则的经典表述为“法无明文规定不为罪”“法无明文规定不处罚”，其核心价值就是限制权力，保障人权。我国刑法是人权保障的最后防线，为了保障人权，我国刑法大部分是禁止性的法律规范，也就是说我国是通过刑罚权的行使来达到保障人权这一终极价值，但为了防止刑罚权的滥用，我国刑法将罪刑法定原则作为刑法的首要原则，以保障人权。[1-2]

The principle of punishment proportional to crime can be expressed classically as "nullum crimen sine lege” and“nulla poena sine lege”.Its core value is limiting the power and protecting human rights .In order to safeguard the human rights , most of China's criminal law is prohibitive legal norms , that is to say , our country is to protect human rights by exercising the power of criminal penalty---the ultimate value .However , in order to prevent abuse of the power of criminal penalty , our criminal law re-gards the principle of a legally prescribed punishment as the first principle for safeguard human rights .
