转型期社会矛盾频发，司法解纷不堪重荷，多元纠纷解决机制的构建迫在眉睫，与传统诉讼相比，行政调解具有高效、便捷之优势，其在专利纠纷方面表现得更为突显。但由于认识的偏差与制度的缺失，专利行政调解在实践中频遭冷遇，必须通过规整操作实践，确立调解原则，完善法律体系、建构诱因并宣传等多方面措施的并行，才能实现良好有效的运作，才能实现其真正的制度价值。

Owing to the frequent social conflicts and unbearable burden of judicial dispute in the social transformation period, the construction of multiple dispute resolution mechanism is imminent. Compared with the traditional litigation, administrative mediation has the advantages of high efficiency and convenience, especially in the aspect of patent disputes. However, due to the deviation of understanding and lack of system, the patent administrative dispute in practice encounters great barriers;therefore, it is necessary to normalize the operating practice, establish the principle of mediation, perfect the legal system and construct the incentives so as to achieve a favorable and effective operation and its real institutional value.
