近年来,人格权成为学界关注的一个热点问题。但是现有的研究大多集中在人格权法是否独立成篇的问题上,而忽视了人格权的基本问题研究。人格具有多种含义,人格权中的人格应该是指人格利益,人格权是自然人享有的对其人格利益的权利,人格权是支配权、绝对权、非财产权。基于法理逻辑和制度安排的效果考虑,法人无人格权。另一方面,一般人格＂权＂,其实也并非权利而是法益,不宜在立法规定所谓的一般人格＂权＂。

In recent years,the personality right has become a hot issue.But the existing researches mostly focus on the question whether personality right law should be independent in the civil code,but the basic problems of the personality right have been ignored.Personality has many implications.The personality in right of personality should refer to personality interests,and the personality right is the right enjoyed by natural individuals on their personality interests.The right of personality is dominant right,absolute right and non-property right.On the basis of the legal logic and the impacts of different institutional arrangements,corporation has no right of personality.On the other hand,the general personality "right",actually is not a civil right but legal interests.Therefore,we shouldn't prescribe the so-called general personality "right" in our civil code.
