《合同法》第49条规定的表见代理，在构成要件上虽然无须被代理人存在过失，但须有被代理人的行为与代理权的外观假象之间存在关联性，同时该条规定的“相对人有理由相信”是指相对人善意且无过失。代理权的外观假象既可以是被代理人的积极行为引发，也可以是消极行为引发。表见代理的法律效果是“该代理行为对第三人有效”，被代理人不得主动主张该代理行为的效力。
《閤同法》第49條規定的錶見代理，在構成要件上雖然無鬚被代理人存在過失，但鬚有被代理人的行為與代理權的外觀假象之間存在關聯性，同時該條規定的“相對人有理由相信”是指相對人善意且無過失。代理權的外觀假象既可以是被代理人的積極行為引髮，也可以是消極行為引髮。錶見代理的法律效果是“該代理行為對第三人有效”，被代理人不得主動主張該代理行為的效力。
《합동법》제49조규정적표견대리，재구성요건상수연무수피대리인존재과실，단수유피대리인적행위여대리권적외관가상지간존재관련성，동시해조규정적“상대인유이유상신”시지상대인선의차무과실。대리권적외관가상기가이시피대리인적적겁행위인발，야가이시소겁행위인발。표견대리적법률효과시“해대리행위대제삼인유효”，피대리인불득주동주장해대리행위적효력。
The section 49 in the Contract Law of PRC provides the apparent agency. Although without demand of the existence of the principal' s negligence in constitutive requirements, the connection between the behavior of the principal and the false appearance of the agent authority should be required. Meanwhile, this section regulates "counterparty' s reasonable belief" which is defined that the eounterparty should believe with good faith but non-negligence. The false appearance of the agency authority would be resulted from not only active behaviors of the principal but also negative activities. The legal effect of the apparent agency is that the agent activity is effective to the third party which is equivalent to that the principal should not argue the effect of this agent activity.
