20世纪90年代,中国实行的＂一步到庭＂产生了很多问题,由于开庭审理前没有进行争点整理和证据固定,很容易造成案件多次开庭审理,严重影响了司法效率。结合我国的具体国情,以我国民事诉讼目的为出发点和归宿,在现阶段采取以偏向职权主义诉讼模式,辅之以当事人主义诉讼模式的特点为基本思路,增加答辩和证据制度,在一定情况下发挥法官的释明权,构建中国特色的审前准备程序。
20世紀90年代,中國實行的＂一步到庭＂產生瞭很多問題,由于開庭審理前沒有進行爭點整理和證據固定,很容易造成案件多次開庭審理,嚴重影響瞭司法效率。結閤我國的具體國情,以我國民事訴訟目的為齣髮點和歸宿,在現階段採取以偏嚮職權主義訴訟模式,輔之以噹事人主義訴訟模式的特點為基本思路,增加答辯和證據製度,在一定情況下髮揮法官的釋明權,構建中國特色的審前準備程序。

In the 1990s,hearing without full preparation in China caused many problems.Judges did not generalize the dispute points and evidences before trial,which easily caused many hearings and seriously influencing judicial justice.According to the our specific national conditions,with civil proceeding purpose as the starting point and destination,we should adopt the inquisitorial system-based proceeding model in addition to the adversary system-based proceeding system at present stage and add defence and evidence system,that is to say,to give play to judges' right of interpretation and establish pre-trial preparation procedure with the Chinese features.
