未成年人的人身自由权与父母的监护权之间的冲突和矛盾从其诞生的那一刻起就已注定，不仅是历史的，而且是现实的；不仅表现在立法层面，而且已经浮现于司法层面。有必要对父母的监护权和未成年人的人身自由权实施动态制衡，进而达到彼此间的平衡，使这两种权利有各自适合的施展空间。
未成年人的人身自由權與父母的鑑護權之間的遲突和矛盾從其誕生的那一刻起就已註定，不僅是歷史的，而且是現實的；不僅錶現在立法層麵，而且已經浮現于司法層麵。有必要對父母的鑑護權和未成年人的人身自由權實施動態製衡，進而達到彼此間的平衡，使這兩種權利有各自適閤的施展空間。
미성년인적인신자유권여부모적감호권지간적충돌화모순종기탄생적나일각기취이주정，불부시역사적，이차시현실적；불부표현재입법층면，이차이경부현우사법층면。유필요대부모적감호권화미성년인적인신자유권실시동태제형，진이체도피차간적평형，사저량충권리유각자괄합적시전공간。
Minor personal freedom and custody of the parents of conflict and contradiction between from its birth the moment of al- ready doomed, is not only the history, and is realistic ; only in legislative level, and has floated in judicial level. The author thinks that it is necessary to custody of the parents and the minors'implementation of personal freedom of dynamic balance, which reached their value peace between the balances, so that the two rights have their own respective suitable display space.
