宅基地有主体特定性、无偿和无期限性、财产性、原始取得唯一性、取得要依法审批、流转限定性等法律特征。存在的主要问题有:实践中“一户一宅”规定难落实;宅基地使用权限制流转与宅基地之上房屋所有权允许流转之间相互矛盾;宅基地使用权“无偿、无期限、无流动”的缺陷与宅基地使用权退出、流转机制缺失之间存在矛盾;宅基地审批制度有待于进一步完善。完善宅基地使用权法律制度的建议:准确理解一户一宅,严格宅基地面积标准;房地一体,推进宅基地使用权有序流转;显化价值,建立宅基地有偿使用和退出机制;不断加强宅基地登记发证工作;开展宅基地使用权抵押试点。

This paper first introduces the legal characteristics of the residential bases, such as the subject of specific, free and no time limit, property, the uniqueness of original acquisition, the acquisition must be examination and approval in accordance with the law, and the definition of transfer. Following from this, this paper analyses the main problems, these are: in practice, it is difficult to implement the provision of“one family one house”;the restriction of circulation of the right to use of homestead and the transfer permission of ownership of the house on the homestead contradict each other; there is also a conflict between the imperfection of rural homestead-land-use-right, such as free, no time limit and no circulation, as well as the quit of rural homestead-land-use-right, and short of transfer mechanism;homestead examination and approval system needs to be improved. On this basis, this paper offers some suggestions for improving legal system of the right to use homestead:we should accurately understand“one family one house”, and strictly enforce the standard of the homestead area. At the same time, we should promote the orderly transfer of the right to use homestead, establish land paid use and exit mechanism, strengthen the registration certification, and carry out the pilot of raising a mortgage on the right to use homestead.
