曾经风光无限的导游如今成为众多旅游纠纷中的众矢之的。强迫购物、改点加点、甩团离团、殴打谩骂游客等都被认为是导游惹的祸。其实，导游也是受害者，内容陈旧粗疏的《导游人员管理条例》无法充分保护导游的舍法权益，使其不得已而“为恶”。文章认为，应当制定一部内容全新、效力更高的《导游人员法》。同时要提高导游的从业资格，建立以基本工资为主，带团津贴和佣金为辅的薪酬办法并赋予导游报酬请求权，适当放宽导游禁止执业的条件。唯此，方能形成融洽的导游一游客关系和规范的旅游市场并最终有利于提升我国的国家形象。

Guide which once deemed as an enviable job now is involved into tourism disputes as a core target. Forced shopping, changing route, rejecting clients, physical and verbal abuse on clients are all be thought as tourists＇ faults. In fact, guide is also the victim because the Management Regulations for touring guides has been past time and crude which can not protect the tights of guides and make the guides have to do bad. In this paper the author take the view that a new and more powerful Law for touting Guides shall be legislated and at the same time promote the prerequisites for guides. The author also think that the basic salary based and bonus/commission supplemented paying system shall be built and guides shall be entitled the tights of pay asking and he conditions of practice prohibit shall be eased. Only by these harmonious relations between guides and clients can be formed and at last promote our country＇s national image.
