审前羁押替代措施在我国面临着适用不足而审前羁押率过高的窘境，国内对此的研究多停留在法律条文层面，难以为司法实践提供更多的理论指导。文章在技术层面上提出了以认识并控制其中的诉讼风险来提高审前羁押替代措施适用比例的观点，再通过梳理国内外的研究脉络和实践经验，主张至少应当从调查、评估与控制三个维度对审前羁押替代措施的诉讼风险展开研究，同时应注重参与主体的多元化、诉讼风险评估的客观性以及诉讼风险控制的全面性，建立以量化的诉讼风险指标为基础的决策参考体系。

Substitutive measure of pre-trial detention in China is facing shortage of application and the high rate of detention. Domestic study on this stays on the level of laws and regulations, which is hard to provide more theoretical guide for judicial practice. The authors proposed at the technical level to understand and control the risk of litigation to improve substitutive measures of pretrial detention proportion. Through the re-search and practical experience at home and abroad, the authors advocated that we should at least carry out research on litigation risk of pretrial detention substitutive measures from three dimensions including investi-gation, evaluation and control. And also they mentioned that we should focus on the diversity of subject, ob-jectiveness of the litigation risk assessment and comprehension of litigation risk control to establish the deci-sion-making reference system based on quantified litigation risk index.
