动产抵押权客体的范围是动产抵押制度研究过程中的一个重要课题。由于我国动产抵押采取了登记对抗主义的物权变动模式,这就使得动产抵押制度因为物权的公示公信力而陷入了进退维谷的境地。通过分析国内外动产抵押权客体的立法例证,研究限制动产抵押权客体的范围与解决物权公示公信力问题的关系,为如何认定动产抵押物转让的效力、实现动产抵押制度中各方当事人利益平衡提供理论依据。

The scope of chattel mortgage object is an important subject in the process of chattel mortgage system research.In China,chattel mortgage takes the real right alteration mode of registration confrontation doctrine and therefore has made the chattel mortgage system in the position of the dilemma because of the public credibility of real right.This article,through the analysis of domestic and foreign chattel mortgage object legislation,studies the relationship between the limitation of the chattel mortgage object scope and solving the question of public credibility of real right.The paper provides theoretic basis for the determination of the effectiveness of the transfer of moveable pawn,and realization of the interest balance of all parties in chattel mortgage system.
