中国传统武术作为非物质文化遗产的一部分,是一种智力成果,应受到知识产权的保护。但由于我国现行知识产权法并未明确将传统武术纳入保护范围,而保护传统武术的专门法律法规尚未建立,导致出现武术遭受侵权而无法得到有效救济的现状,一定程度上抑制了武术的对外交流和传播推广。对武术文化的法律保护问题进行分析并提出对策建议,旨在唤起社会各界对传统武术知识产权保护意识,加强相关法律法规的建立与完善,为武术知识产权保护提供理论依据。

As a part of intangible cultural heritage,the traditional Chinese martial arts is an intellectual achievement and it should be protected by the intellectual property right.However,the traditional Chinese martial arts is not included in the protection scope of current intellectual property laws,and the professional law and regulation on tradition martial arts have not been established.This causes infringement of traditional Chinese martial arts and there isn＇t any effective measure,which,to some extent,restrain the communication and dissemination of martial arts.The purpose of this paper is to arouse the intellectual property rights consciousness of the society to protect traditional martial arts and establish and perfect relative laws and regulations,providing theoretical references for the intellectual property protection of martial arts.
