刑诉法修正案草案将强制措施做了较大修改，占到了此次修改条款的四分之一左右，足见立法者的重视，其中司法审查原则有所涉及，是其进步之处。但是并未将司法机关签发速捕证、拘留证等进行规定。而且也未涉及审查羁押的合法性和必要性。我国应当适当将域外刑事强制措施的司法调控，引入我国的司法调控体制并加以完善。

The modification of compulsory measures account for a large proportion（ approximate a quarter ）in draft amendments to the criminal law , so the legislators＇ attention of compulsory measures can be seen, and in the draft the judicial review prin- ciples are not touched upon, which is a progress. But there is no rule of issuing the detention warrant and arrest warrant by the judiciary, and the necessity and legitimacy of pretrial detention are not touched, too. We presented the judicial regulation of extraterritorial compulsory measures, and indicated that the judicial regulation should be introduced in China, finally, we have given a blameless proposal for it by combining with the specific principles.
