酌定量刑情节是量刑情节的一种,能够反映犯罪分子的人身危险性和犯罪行为的社会危害程度,对宣告刑起着至关重要的作用,影响着刑罚的裁量与免除,直接关系到量刑的公正程度。但是,由于目前刑法理论界对酌定量刑情节的研究尚未完善,各地经济、政治发展不平衡,法官职业素质良莠不齐,对酌定量刑情节的理解和运用存在不合理因素,造成司法不公正的现象。酌定量刑情节的理性运用迫在眉睫。

However, due to current criminal law theory about discretionary sen- tencing plot research has not been perfected yet, judicial practice because of nationwide economic, political development is not bal- anced, judge the good and bad are intermingled, professional quality of discretionary given circumstances of understanding and using existing unreasonable factors, causing the judicial unjust phenomenon massive existence. Discretionary given circumstances rational use is imminent. This article tries to discretionary given circumstances theoretical understanding, in sentencing the important position and in judicial practice governed by this plot existed problems of rational use, and then put forward some Suggestions of the discre- tionary given circumstances.
