《居民身份证法》修改,规定身份证增加指纹信息,其本质是新赋了国家占有公民指纹隐私的权力,是对公民宪法隐私权的限制。这一限制不符合国家限制公民宪法基本权利必须遵循的目的合理原则和比例原则。新法在赋予国家占有公民隐私权力的同时,缺乏对公民指纹隐私的安全保障,使公民指纹隐私安全受到极大的挑战。此次《居民身份证法》修改,国家警察权力进一步扩大,公民权利进一步限缩,有违限制国家权力、保障公民权利的宪政宗旨。
《거민신빈증법》수개,규정신빈증증가지문신식,기본질시신부료국가점유공민지문은사적권력,시대공민헌법은사권적한제。저일한제불부합국가한제공민헌법기본권리필수준순적목적합리원칙화비례원칙。신법재부여국가점유공민은사권력적동시,결핍대공민지문은사적안전보장,사공민지문은사안전수도겁대적도전。차차《거민신빈증법》수개,국가경찰권력진일보확대,공민권리진일보한축,유위한제국가권력、보장공민권리적헌정종지。
The Law of the People＇s Republic of China on Resident Identity Cards has been amended and the new law set a new rule that fingerprints should be registered on a resident identity card,the essence of which is giving the nation the power of collecting people＇s privacy of fingerprints,whereas limiting citizens＇ constitutional right of privacy.This limitation was not in line with the principle of reasonable purpose and the principle of proportionality that the nation must follow when the nation limited citizens＇ constitutional civil rights.When the new law gave the nation right to possess the citizen＇s privacy,it lack of security guarantee of citizens＇ fingerprints which gives big challenges to the civil privacy.The new law further expended the power of national police,limited the civil rights,contrary to the constitutional purposes of limiting state power and protecting the civil rights.
