行政部门立法在我国立法体制中占有重要地位,该立法模式既有一定的优越性,也有一定的风险性。立法后评估制度是规避行政部门立法风险的重要途径。通过对国土资源部立法后评估制度建设的个案分析,总结行政部门立法后评估制度构建的相关理论,对推动我国行政立法水平乃至全社会法制建设都具有重要作用。
