我国现行法律无亲亲相隐制度之规定，而中国古代以及域外一般对该制度都明确予以法律规定。运用亲亲相隐制度有利于贯彻宽严相济刑事政策，符合期待可能性理论，有助于社会资源和刑事司法资源的节省。在我国，有必要在刑事法律中明确规定亲亲相隐制度。在刑法总则中明确规定亲亲相隐是公民的权利，同时对亲亲相隐制度中的亲属范围作出明确规定，对行为人的行为方式予以限制。在刑事诉讼法中确认亲属的沉默权、拒证权，同时明确规定司法机关对亲亲相隐的告知义务。

Chinese current law does not provide kin concealment system .Ancient China and foreign countries generally defined it clearly in law system .It's conducive to implementing temper justice with mercy , in line with expectation possibility theory and saving social resources and criminal justice resources .It's neces-sary to clearly define kin concealment system in our criminal law .The general provisions of criminal law should clearly define it as a citizen right .At the same time , the law should provide a scope of kindred and re-strict the perpetrator's behaviors.It should be confirmed that the relatives have right to remain silent , the right to refuse to admit and judicial authority should implement the obligation of informing kin concealment system .
